Child Car Restraint Installations Terms and Conditions
Tidy Riders Child Car Restraint Installation Terms & Conditions
These Terms & Conditions apply to child car restraint installations, inspections, safety checks and adjustment services provided by Tidy Riders.
1. Our Service
Tidy Riders provides professional child car restraint fitting, installation, inspection and safety check services.
Tidy Riders operates as an independent child restraint fitting business. Our installers are appropriately accredited for the services they provide and installations are completed in accordance with applicable Australian requirements, manufacturer instructions and recognised child restraint fitting practices.
The purpose of an installation or safety check is to ensure that the restraint is fitted and adjusted as safely and appropriately as reasonably possible for the vehicle, restraint and information available at the time of the appointment.
2. Child Restraint Standards
Child car restraints used in Australia are required to comply with the applicable Australian Standard, including AS/NZS 1754 where applicable.
Tidy Riders will only install or inspect restraints that are suitable for use in Australia and that meet applicable Australian requirements, subject to the condition and history of the individual restraint.
Tidy Riders may decline to install a restraint where it appears to be unsafe, damaged, expired, unsuitable for the vehicle or child, missing required components, subject to an unknown history, or otherwise unsuitable for installation.
Where Tidy Riders declines an installation for safety reasons, the hirer or owner remains responsible for determining an appropriate replacement or alternative restraint.
3. Customer Responsibility
The customer is responsible for providing accurate information about the vehicle, restraint and child for whom the restraint is intended.
The customer is responsible for ensuring that the restraint selected is appropriate for the child and vehicle.
Tidy Riders can provide general guidance about restraint suitability and installation but does not make the final decision on which restraint a customer purchases or uses.
The customer must advise Tidy Riders of any relevant information that may affect the installation, including previous modifications, known damage, previous crashes involving the restraint, changes to the vehicle, or any other known issue.
4. Installation & Safety Checks
During an installation, Tidy Riders will assess the restraint and vehicle and install or adjust the restraint using the manufacturer's instructions and applicable fitting requirements.
Where appropriate, Tidy Riders may provide education about:
- correct use of the restraint;
- harness adjustment;
- child positioning;
- tether straps and anchorage points;
- ISOFIX or other attachment systems;
- recline or adjustment settings; and
- ongoing checks and adjustments required as the child grows.
The customer is encouraged to ask questions during the appointment and should not leave the appointment if they are unsure how to use or adjust the restraint.
A safety check or inspection is an assessment of the restraint and its installation at the time of the appointment. It does not constitute a guarantee that the restraint will remain correctly installed or adjusted indefinitely.
5. Responsibility After Installation
Once the customer leaves the installation appointment, the customer is responsible for ensuring that the restraint remains correctly installed and is used in accordance with the manufacturer's instructions.
The restraint may require adjustment as the child grows or their circumstances change.
The customer should check the restraint regularly and before use, particularly after the restraint has been removed, adjusted, moved to another seating position or vehicle, or otherwise altered.
If the customer is unsure whether the restraint remains correctly installed or adjusted, they should arrange another inspection with an appropriately qualified child restraint fitter.
Tidy Riders is not responsible for changes made to the restraint or vehicle after the installation, including removal, reinstallation, adjustment, alteration or movement by the customer or another person.
6. Restraints With Existing Issues
Tidy Riders may identify issues with a restraint that existed before the appointment.
This may include:
- damaged or worn harnesses or straps;
- damaged restraint shells;
- missing components;
- incorrect or incompatible accessories;
- previous crash involvement;
- expired or unsuitable restraints;
- incorrect previous installation; or
- other defects or concerns.
Where an issue is identified, Tidy Riders will advise the customer where reasonably possible and may recommend that the restraint not be used.
Tidy Riders will not knowingly install or approve a restraint that is considered unsafe or unsuitable.
7. Vehicle Compatibility & Modifications
Not every child restraint is suitable for every vehicle or seating position.
Tidy Riders will assess the available seating position and installation requirements at the time of the appointment.
Where a safe and appropriate installation cannot be achieved, Tidy Riders may recommend an alternative seating position, restraint or installation method.
Tidy Riders does not modify vehicles or install additional anchorage points unless specifically authorised and appropriately qualified to do so.
The customer is responsible for ensuring that any required vehicle modifications or additional anchorage points are legally installed by an appropriately qualified person.
8. Vehicle Wear & Minor Damage
The customer understands that installing and using a child car restraint can result in minor or unavoidable marks to the vehicle.
This may include:
- indentations or impressions in vehicle seats;
- pressure marks;
- minor scuffing or marks to upholstery;
- distortion of seat fabric or cushioning;
- marks from seat belts or restraint components; and
- minor marks to leather or other vehicle surfaces.
Tidy Riders takes reasonable care when working in vehicles but cannot guarantee that these types of marks will not occur.
Customers should advise Tidy Riders before installation if their vehicle has delicate, premium or modified interior surfaces or any specific care requirements.
To the fullest extent permitted by law, Tidy Riders is not responsible for normal or unavoidable wear associated with the installation or use of a child restraint, except where the damage is directly caused by Tidy Riders' negligence or intentional conduct.
9. Safe Use of Child Restraints
The customer acknowledges that travelling in a motor vehicle carries inherent risks and that child car restraints are designed to reduce the risk of serious injury in the event of a crash.
Correct installation is only one part of safe restraint use.
The customer remains responsible for:
- correctly securing the child in the restraint on every trip;
- ensuring the harness is correctly adjusted;
- following the restraint manufacturer's instructions;
- using the restraint in accordance with applicable Australian requirements;
- ensuring the restraint remains correctly installed;
- regularly checking the restraint; and
- obtaining further professional advice or an inspection when required.
Tidy Riders recommends following current Australian best practice guidance for the safe restraint of children in motor vehicles.
10. Changes, Adjustments & Reinstallation
Customers must not assume that a restraint remains correctly installed after it has been removed, moved or adjusted.
If the restraint is moved to another vehicle, another seating position or significantly adjusted, a new installation or safety check may be required.
Tidy Riders is not responsible for an installation after the customer or another person has altered, removed, reinstalled or adjusted the restraint.
11. Cancellations & Appointments
Customers should provide as much notice as possible if they need to cancel or reschedule an appointment.
Where a customer does not attend an appointment or provides insufficient notice to reasonably allow the appointment to be rebooked, Tidy Riders may retain any applicable booking fee or charge a cancellation or missed appointment fee.
Where Tidy Riders needs to cancel or reschedule an appointment due to illness, unsafe weather, vehicle access issues or other circumstances outside reasonable control, Tidy Riders will provide as much notice as reasonably possible and arrange an alternative appointment where available.
12. Customer & Vehicle Access
For mobile installations, the customer must provide safe and reasonable access to the vehicle at the agreed location.
The vehicle should be parked in a safe, accessible location with sufficient space for the installer to work.
Tidy Riders may postpone or decline an installation if the location or vehicle cannot be accessed safely or if conditions present an unreasonable risk to the installer or customer.
13. Liability
The customer understands that travelling with children in motor vehicles involves inherent risks and that no child restraint or installation can completely eliminate the risk of injury in a motor vehicle accident.
Tidy Riders takes reasonable care when performing installation and safety check services. However, to the fullest extent permitted by law, Tidy Riders is not responsible for loss, injury, illness, death, damage or other harm arising from:
- a motor vehicle accident;
- incorrect use of the restraint;
- incorrect harness adjustment;
- failure to secure the child correctly;
- failure to follow manufacturer instructions;
- changes or adjustments made after the appointment;
- removal or reinstallation of the restraint by another person;
- use of a restraint in a manner contrary to its intended purpose;
- failure to disclose relevant information about the restraint or vehicle;
- circumstances outside Tidy Riders' reasonable control; or
- the inherent risks associated with travelling in a motor vehicle.
Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot legally be excluded under the Australian Consumer Law or any other applicable law.
Nothing in these Terms & Conditions limits Tidy Riders' liability for loss or damage caused by Tidy Riders' own negligence, to the extent that such liability cannot legally be excluded.
14. Indemnity
To the fullest extent permitted by law, the customer releases and indemnifies Tidy Riders against claims, loss or damage arising from the customer's misuse of the restraint, failure to follow manufacturer instructions, failure to follow applicable requirements, or alteration, removal or reinstallation of the restraint after the Tidy Riders appointment.
This indemnity does not apply to loss or damage caused by Tidy Riders' own negligence or other liability that cannot legally be excluded.
15. No Guarantee of Crash Outcome
A professional installation is intended to ensure that the restraint is fitted correctly at the time of the appointment.
However, Tidy Riders does not guarantee that a child will avoid injury in the event of a motor vehicle accident.
The outcome of a motor vehicle accident can be affected by many factors outside the control of Tidy Riders, including vehicle impact, crash severity, direction of impact, vehicle damage, road conditions and other circumstances.
16. Professional Advice & Scope of Service
Tidy Riders provides child restraint fitting and safety information within the scope of its training and accreditation.
Tidy Riders does not provide medical, legal, engineering or other specialist advice outside the scope of the fitting service.
Where a child's individual needs, a vehicle modification, medical condition or other specialised circumstance requires advice outside the scope of a standard fitting appointment, the customer may be referred to an appropriately qualified professional.
17. Acceptance of Terms
By booking, attending or accepting a child car restraint installation or safety check service from Tidy Riders, the customer acknowledges that they have had the opportunity to read these Terms & Conditions and agrees to comply with them.
The customer also acknowledges that they remain responsible for the correct ongoing use of the restraint after the appointment and should seek further professional assistance if they are unsure about its installation or use.
SNOO Hire Terms and Conditions
Tidy Riders SNOO Smart Sleeper Hire Terms & Conditions
These Terms & Conditions apply to all SNOO Smart Sleeper hires provided by Tidy Riders.
1. Hire Agreement
Tidy Riders is the owner of the SNOO Smart Sleeper and all accessories and equipment supplied as part of the hire.
The SNOO is provided for private, domestic use only and must not be sold, sub-hired, transferred to another person or used for any commercial purpose without written permission from Tidy Riders.
By commencing a hire, the hirer agrees to comply with these Terms & Conditions and to take reasonable care of all hired equipment.
2. Hire Period & Weekly Payments
SNOO hire is charged on a weekly basis.
The hirer may cancel or end their hire at any time. However, weekly hire charges will continue until the SNOO and all items included in the hire package have been returned to Tidy Riders.
If only part of the hire package is returned, the weekly hire charge will remain payable until all outstanding items have been returned.
The hirer may request to extend the hire period at any time, subject to the SNOO being available and not already reserved for another customer.
Tidy Riders may end a hire agreement where reasonably necessary, including where the equipment is required for another confirmed booking, is being misused, or the terms of the hire are not being followed. Where applicable, Tidy Riders will provide reasonable notice and refund any prepaid hire amount relating to a period that will no longer be provided.
3. Security Deposit
A security deposit must be paid in full before the SNOO is collected or delivered to the hirer.
The security deposit is refundable following the return and inspection of the SNOO and all supplied equipment, provided there are no outstanding hire charges, damage, excessive soiling, missing items or other costs payable by the hirer.
Tidy Riders may deduct from the security deposit:
- outstanding weekly hire charges;
- cleaning costs;
- repair costs;
- replacement costs for missing or damaged items; or
- any other reasonable costs arising from loss, damage or misuse of the hired equipment.
Where the cost exceeds the security deposit, the hirer remains responsible for the outstanding amount.
4. Return of Equipment
All items supplied as part of the hire must be returned to Tidy Riders at the end of the hire period.
This includes the SNOO, mattress, sheets, swaddles/sacks, boxes, power components and any other accessories or equipment supplied with the hire.
If an item is not returned, the applicable replacement cost may be deducted from the security deposit.
Any sheets or SNOO swaddles/sacks that are not returned will be charged at their current recommended retail price.
If the SNOO itself is not returned, the hirer will be responsible for the full replacement cost of the SNOO based on its current recommended retail price at the time it is not returned, less any amount already held as a security deposit.
5. Care & General Use
The SNOO must be used carefully and only for its intended purpose.
The hirer is responsible for following the manufacturer's instructions and maintaining safe sleep practices throughout the hire period.
The hirer must:
- use only SNOO-approved swaddles/sacks designed for use with the SNOO;
- not feed a baby a bottle while they are in the SNOO;
- not modify, repair, dismantle or attempt to service the SNOO;
- not attempt to clean the SNOO itself;
- keep liquids, food and other substances away from the SNOO where reasonably possible;
- take reasonable care to prevent damage, excessive soiling or staining; and
- contact Tidy Riders immediately if any damage, defect or fault is noticed.
If the SNOO develops a fault, appears damaged or is otherwise not functioning correctly, use must be discontinued until Tidy Riders has assessed the issue.
6. Cleaning, Damage & Excessive Wear
Tidy Riders will provide the SNOO in a safe, clean and hygienic condition at the commencement of the hire.
Normal and reasonable wear and tear associated with ordinary use is expected.
Excessive wear, damage or soiling may result in a cleaning, repair or replacement charge. This may include:
- spilled milk or other liquids;
- stains;
- heavy soiling;
- vomit or other bodily fluids;
- damage caused by improper use or cleaning;
- rips or tears to the mesh or other components;
- damage to electrical or mechanical components; or
- missing or damaged accessories.
Cleaning charges will be determined by Tidy Riders based on the extent and severity of the cleaning required.
Damage requiring repair will be assessed individually, and reasonable repair or replacement costs may be deducted from the security deposit.
7. Safe Sleep & Suitability
The hirer is responsible for determining whether the SNOO is suitable for their circumstances and for ensuring that it is used in accordance with current safe sleep recommendations and the manufacturer's instructions.
Hirers should conduct their own research before choosing a bassinet or sleep product and should seek appropriate professional advice where required.
Tidy Riders does not provide medical, health or sleep advice and does not guarantee that the SNOO will be suitable for every baby or situation.
The hirer remains responsible for supervising the baby's use of the SNOO and for maintaining safe sleep practices at all times.
8. Damage or Defects During Hire
The hirer must contact Tidy Riders immediately if they notice any damage, defect, unusual operation or fault with the SNOO or any supplied equipment.
The hirer must discontinue use of the SNOO if they believe there is a safety issue, damage or defect that could affect safe operation.
The hirer must not attempt to repair, modify or service the SNOO themselves.
Tidy Riders will assess the issue and, where appropriate, arrange repair, replacement or an alternative solution.
9. Delivery & Collection
Where Tidy Riders has agreed to deliver and collect the SNOO, Tidy Riders will arrange the delivery and collection directly with the hirer.
Where the hirer has agreed to collect and return the SNOO themselves, the hirer is responsible for arranging and completing the collection and return independently.
The hire period and weekly charges remain in effect until the SNOO and all hired equipment have been returned to Tidy Riders.

11. Liability & Indemnity
The hirer acknowledges that the use of a bassinet and sleep product carries inherent risks and that safe use depends on following the manufacturer's instructions and appropriate safe sleep practices.
To the fullest extent permitted by law, Tidy Riders is not responsible for injury, illness, loss or damage arising from the hirer's misuse of the SNOO, failure to follow the manufacturer's instructions, failure to maintain safe sleep practices, failure to report a known defect or damage, or use of the equipment contrary to these Terms & Conditions.
To the fullest extent permitted by law, the hirer releases and indemnifies Tidy Riders against claims, loss or damage arising from the hirer's misuse, negligence or failure to comply with these Terms & Conditions.
Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
Nothing in these Terms & Conditions limits Tidy Riders' liability for loss or damage caused by Tidy Riders' own negligence, to the extent that such liability cannot legally be excluded.
12. Acceptance of Terms
By paying for, collecting or accepting delivery of the SNOO, the hirer acknowledges that they have had the opportunity to read these Terms & Conditions and agrees to comply with them for the duration of the hire.

The hirer is responsible for selecting equipment that is appropriate for their individual circumstances and for ensuring that they understand how to use the equipment safely and correctly.
2. Hire Period & Weekly Payments
Equipment hire is charged on a weekly basis unless otherwise agreed.
The hirer may cancel or end their hire at any time. However, weekly hire charges will continue until the equipment and all items included in the hire package have been returned to Tidy Riders.
If only part of the hire package is returned, the weekly hire charge will remain payable until all outstanding items have been returned.
The hirer may request to extend the hire period at any time, subject to the equipment being available and not already reserved for another customer.
Tidy Riders may end a hire agreement where reasonably necessary, including where equipment is required for another confirmed booking, is being misused, or these Terms & Conditions are not being followed. Where applicable, Tidy Riders will provide reasonable notice and refund any prepaid hire amount relating to a period that will no longer be provided.
3. Security Deposit
Where a security deposit is required, it must be paid in full before the equipment is collected or delivered to the hirer.
The security deposit is refundable following the return and inspection of all hired equipment, provided there are no outstanding hire charges, damage, excessive soiling, missing items or other costs payable by the hirer.
Tidy Riders may deduct from the security deposit:
- outstanding weekly hire charges;

- replacement costs for missing or damaged items; or
- other reasonable costs arising from loss, damage or misuse of the equipment.
Where costs exceed the security deposit, the hirer remains responsible for the outstanding amount.

This may include, but is not limited to, car restraints, baby capsules, prams, bassinette components, covers, inserts, straps, adaptors, carry bags, boxes and other supplied accessories.
If an item is not returned, the applicable replacement cost may be deducted from the security deposit.
If the main item of equipment is not returned, the hirer will be responsible for the full replacement cost based on the current recommended retail price of an equivalent replacement item at the time it is determined to be missing.
5. General Care & Use
All equipment must be used carefully and only for its intended purpose.
The hirer must follow the manufacturer's instructions and any safety instructions provided by Tidy Riders.
The hirer must:
- use the equipment only for its intended purpose;
- take reasonable care to prevent damage, loss or excessive soiling;
- keep all equipment indoors when not in use;
- keep equipment away from direct sunlight, excessive heat, damp and wet areas;
- not modify, repair, dismantle or attempt to service equipment;

- contact Tidy Riders as soon as possible if equipment is damaged, lost, develops a fault or is otherwise not functioning correctly.
Tidy Riders manages all cleaning of hired equipment. This is to ensure that cleaning is carried out in accordance with applicable manufacturer guidelines and appropriate industry practices.
6. Child Car Restraints & Baby Capsules
All child car restraints and baby capsules supplied by Tidy Riders for hire are selected to meet the applicable Australian child restraint requirements and are maintained and inspected by Tidy Riders.
Tidy Riders inspects child restraints before and after each hire period. Equipment is checked for condition, cleanliness, operation and any visible damage before being provided to another customer.
The hirer is responsible for ensuring that the child restraint is appropriate for the child and vehicle in which it is being used and that it is installed and used correctly.
The hirer must:
- follow the manufacturer's instructions;
- follow applicable Australian child restraint requirements and laws;
- ensure the restraint is appropriate for the child's age, size and circumstances;
- ensure the restraint is correctly fitted to the vehicle before use;
- ensure the child is correctly secured in the restraint each time it is used; and
- seek professional assistance if they are unsure how to correctly install or use the restraint.
Where Tidy Riders provides an installation service, this does not remove the hirer's responsibility to ensure that the restraint continues to be used correctly and safely each time the vehicle is driven.
The hirer must not alter, modify, remove or replace any component of a child restraint without prior approval from Tidy Riders.
Food & Soiling
Food is not permitted to be consumed while using a hired child car restraint or baby capsule.
Beverages other than water should not be consumed while the child is secured in the restraint.
Food, milk, beverages, bodily fluids, excessive dirt or other heavy soiling may result in a cleaning fee.
Tidy Riders will determine any cleaning fee based on the extent and severity of the cleaning required.
Hirers must not attempt to clean, wash, dismantle or otherwise treat a child restraint themselves, as incorrect cleaning may compromise the restraint or breach manufacturer requirements.
7. Vehicle Damage & Normal Use
The hirer understands that installing and using a child car restraint or baby capsule may result in unavoidable or normal marks to a vehicle.
This may include:
- impressions or indentations in vehicle seats;
- marks or impressions from restraint components;
- minor scratches or marks to leather or other vehicle surfaces; and
- marks or impressions from vehicle seat belts or other restraint components.
Tidy Riders takes reasonable care when installing and handling child restraints but cannot guarantee that these types of marks will not occur.
To the fullest extent permitted by law, Tidy Riders is not responsible for normal or unavoidable vehicle marks or wear associated with the installation or use of a child restraint, except where the damage has been directly caused by Tidy Riders' negligence or intentional conduct.
8. Prams, Baby Carriers & Other Equipment
Prams, baby carriers and other hired equipment must be used in accordance with the manufacturer's instructions and only for their intended purpose.
Prams and other equipment must be stored indoors when not in use.
They must not be stored outside on patios, verandas, balconies or similar areas, and must be protected from direct sunlight, rain, moisture, damp areas and excessive heat.
The hirer must take reasonable care to prevent damage, staining, mould, mildew, fading or deterioration caused by inappropriate storage or use.
Food and beverages should not be consumed while using hired equipment where this may result in staining, contamination or excessive soiling.
The hirer must not attempt to wash, clean, dismantle, repair or modify any hired equipment.
9. Cleaning, Damage & Excessive Wear

Normal and reasonable wear and tear associated with ordinary use is expected.

- milk or formula spills;
- stains;
- heavy soiling;
- bodily fluids;
- mould or mildew caused by inappropriate storage;
- rips or tears;
- broken or damaged components;
- damage caused by incorrect use or storage;
- damage caused by attempted cleaning or repair; or
- missing accessories or components.
Cleaning fees will be determined by Tidy Riders based on the extent and severity of the cleaning required.
Repair or replacement costs will be assessed individually and reasonable costs may be deducted from the security deposit.
10. Damage or Defects During Hire
The hirer must contact Tidy Riders immediately if they notice any damage, defect, fault or unusual operation involving the hired equipment.
If a child car restraint, baby capsule or other safety-related equipment appears damaged or defective, the hirer must discontinue use until Tidy Riders has assessed the equipment.
The hirer must not attempt to repair or modify the equipment themselves.
Tidy Riders will assess the issue and, where appropriate, arrange repair, replacement or an alternative solution.
11. Safe Use & Suitability
The hirer is responsible for determining whether the hired equipment is suitable for their individual circumstances.
This includes considering the child's age, size, developmental needs, vehicle, intended use and any other relevant circumstances.
The hirer is responsible for reading and understanding the manufacturer's instructions and ensuring that the equipment is used correctly.
Tidy Riders can provide general information about the equipment but does not provide medical, health or other professional advice about whether a particular product is suitable for an individual child.
12. Product Ownership & Manufacturer Disclaimer
All equipment hired through Tidy Riders is independently owned, stocked, maintained and managed by Tidy Riders.
Tidy Riders is an independent business and is not affiliated with, endorsed by, sponsored by or otherwise associated with the manufacturers or brands of the products available for hire.
Brand names and product names are used only to identify the equipment being hired.
The hired equipment is not supplied, rented or serviced by the original manufacturer through Tidy Riders, and the hire agreement is between the hirer and Tidy Riders only.
Any manufacturer warranty, product support or customer service that may be available directly from the manufacturer is separate from the Tidy Riders hire service.
13. Liability & Indemnity
The hirer understands that the use of child restraints, baby capsules, prams, baby carriers and other baby or child equipment involves inherent risks.
In relation to child restraints and baby capsules, the hirer acknowledges that travelling in a motor vehicle carries inherent risks and that the correct use of a child restraint is an important part of reducing those risks.
The hirer is responsible for ensuring that all equipment is used safely, correctly and in accordance with the manufacturer's instructions and applicable laws and standards.
To the fullest extent permitted by law, Tidy Riders is not responsible for loss, injury, illness, death, damage or other harm arising from:
- incorrect use of the equipment;
- incorrect installation or fitting by the hirer or another person;
- failure to follow manufacturer instructions;
- failure to use the equipment in accordance with applicable Australian requirements;
- selecting equipment that is unsuitable for the hirer's circumstances;
- misuse, modification or alteration of the equipment;
- failure to report a known defect or damage; or
- circumstances outside Tidy Riders' reasonable control.
To the fullest extent permitted by law, the hirer releases and indemnifies Tidy Riders against claims, loss or damage arising from the hirer's misuse, negligence or failure to comply with these Terms & Conditions.
14. Delivery & Collection
Where Tidy Riders has agreed to deliver and collect the equipment, Tidy Riders will organise the delivery and collection arrangements directly with the hirer.
Where the hirer has agreed to collect and return the equipment themselves, the hirer is responsible for arranging and completing the collection and return independently.
The hire period and weekly charges remain in effect until the equipment and all hired items have been returned to Tidy Riders.
15. Acceptance of Terms
By paying for, collecting or accepting delivery of hired equipment, the hirer acknowledges that they have had the opportunity to read these Terms & Conditions and agrees to comply with them for the duration of the hire.
Child Restraint Safety Inspection Terms and Conditions
Tidy Riders Free Child Restraint Safety Inspection Terms & Conditions
These Terms & Conditions apply to free child car restraint safety inspections provided by Tidy Riders.
1. What is a Safety Inspection?
A Tidy Riders safety inspection is a brief visual assessment of a child car restraint and its installation.
The purpose of the inspection is to identify obvious concerns with the restraint, its installation or its use and to provide the customer with general information about any issues identified.
A safety inspection is not a full child restraint installation or comprehensive fitting service.
The inspection is intended to provide general guidance and identify potential issues. It does not guarantee that a restraint is completely safe, correctly installed or suitable for every circumstance.
2. Who Conducts the Inspection?
Safety inspections are conducted by either:
- a fully accredited Type 1 child restraint fitter; or
- a trainee child restraint fitter working under the direct supervision of a fully accredited Type 1 child restraint fitter.
Where a trainee conducts the inspection, the supervising Type 1 fitter remains responsible for the inspection and is available to oversee the assessment.
3. Scope of the Free Inspection
The inspection may include a visual assessment of:
- the general condition of the restraint;
- visible damage or wear;
- the restraint's apparent installation;
- harnesses and visible components;
- tether straps and anchorage points;
- visible installation concerns;
- the child's apparent use of the restraint; and
- other obvious issues that can reasonably be identified during a visual inspection.
The inspection does not include the removal, complete reinstallation or comprehensive adjustment of the restraint.
The inspection is based on what can reasonably be assessed at the time of the appointment and does not involve dismantling the restraint or vehicle.
4. Minor Adjustments
At the discretion of the installer, minor adjustments may be made during a safety inspection where they can be completed safely and reasonably within the scope of the inspection.
Examples may include minor harness adjustments or correcting an obvious, easily rectifiable issue.
More involved adjustments, removal and reinstallation of a restraint, changing installation methods, moving a restraint to another seating position or vehicle, or completing a full installation will incur the applicable Tidy Riders installation fee.
Where additional work is recommended, the customer will be advised of this and any applicable fee before the work is undertaken.
The decision to proceed with a paid installation or additional work remains entirely at the customer's discretion.
5. Inspection Report
Where a customer chooses to proceed with the safety inspection only and does not request a full installation, Tidy Riders may provide an inspection report identifying issues or concerns observed during the inspection.
The report is intended to provide the customer with useful information to assist them in addressing the identified issues.
The report may include general recommendations or information about adjustments that may be required.
The report does not constitute confirmation that the restraint is safe, correctly installed or suitable for the child or vehicle.
Where a customer chooses to make their own adjustments following an inspection, they remain responsible for ensuring that the restraint is subsequently installed and used correctly.
6. Customer Responsibility
The customer remains responsible for the selection, installation, adjustment and ongoing use of their child car restraint.
Customers are responsible for:
- ensuring the restraint is appropriate for their child and vehicle;
- following the manufacturer's instructions;
- ensuring the restraint is correctly installed;
- correctly securing the child in the restraint;
- checking the restraint regularly;
- making appropriate adjustments as the child grows; and
- arranging a full professional installation where they are not confident making the required adjustments themselves.
Information provided by Tidy Riders during a safety inspection is general in nature and is provided based on the circumstances and information available at the time of the inspection.
Customers should seek a full professional installation where they are unsure how to correctly install or adjust their restraint.
7. No Installation Guarantee
A safety inspection does not constitute an installation or certification of a child restraint.
Tidy Riders does not guarantee that a restraint is correctly installed, safe for use or suitable for the child or vehicle following a safety inspection.
A restraint may appear satisfactory during a visual inspection while still having issues that cannot reasonably be identified without removing or reinstalling the restraint.
Tidy Riders does not guarantee the ongoing safety or correct installation of a restraint after the inspection.
If the customer subsequently removes, adjusts, reinstalls or otherwise changes the restraint, responsibility for the resulting installation rests with the customer.
8. Child Restraint Standards
Child car restraints used in Australia are subject to applicable Australian requirements and standards, including AS/NZS 1754 where applicable.
Tidy Riders may identify apparent concerns relating to compliance, suitability, condition or installation during an inspection.
Where a restraint appears damaged, expired, unsuitable or otherwise unsafe, Tidy Riders may recommend that it not be used and may recommend replacement or a full professional assessment.
A free safety inspection does not constitute formal certification or legal approval of a restraint.
9. Existing Damage & Restraint History
Customers should provide accurate information about the restraint, including any known previous crash involvement, damage, modifications, repairs or changes.
Tidy Riders may recommend that a restraint not be used where there are concerns about its condition, history or suitability.
Tidy Riders cannot determine the complete history of a restraint where this information has not been provided or is otherwise unknown.
10. Vehicle Wear & Damage
The customer understands that child restraints can cause normal marks or impressions to vehicle seats during installation and use.
This may include:
- indentations or impressions in vehicle seats;
- pressure marks;
- minor marks to upholstery or leather; and
- marks from seat belts or restraint components.
Tidy Riders takes reasonable care when inspecting restraints but cannot guarantee that these marks will not occur.
To the fullest extent permitted by law, Tidy Riders is not responsible for normal or unavoidable vehicle marks associated with the use of a child restraint, except where directly caused by Tidy Riders' negligence or intentional conduct.
11. Liability
The customer acknowledges that travelling in a motor vehicle with a child involves inherent risks and that correct use of a child restraint is an important part of reducing those risks.
A safety inspection is intended to identify obvious concerns but cannot eliminate all risks associated with travelling in a motor vehicle or using a child restraint.
To the fullest extent permitted by law, Tidy Riders is not responsible for loss, injury, illness, death, damage or other harm arising from:
- incorrect use of a child restraint;
- incorrect installation or adjustment carried out by the customer or another person;
- failure to follow manufacturer instructions;
- failure to act on information provided during the inspection;
- changes made to the restraint after the inspection;
- use of a restraint that Tidy Riders has not installed;
- circumstances that could not reasonably be identified during a visual inspection; or
- the inherent risks associated with travelling in a motor vehicle.
12. Recommendations for Further Work
Where Tidy Riders identifies an issue that requires more extensive adjustment or installation, the customer will be advised of the recommended service and any applicable fee.
The customer may choose to:
- proceed with a paid installation or adjustment;
- make the adjustment themselves using the information provided; or
- seek assistance from another appropriately qualified child restraint fitter.
The customer is not required to proceed with a Tidy Riders installation following a free inspection.
13. Acceptance of Terms
By attending a Tidy Riders free safety inspection, the customer acknowledges that they have had the opportunity to read these Terms & Conditions and understands that the service is a visual safety inspection and not a full child restraint installation.
The customer acknowledges that they remain responsible for the correct installation, adjustment and ongoing use of their child restraint.
Cleaning and Detailing Terms and Conditions
Tidy Riders Cleaning & Detailing Terms & Conditions
These Terms & Conditions apply to cleaning and detailing services provided by Tidy Riders for child car restraints, baby capsules, prams, SNOO bassinets and other baby or child equipment.
1. Cleaning & Detailing Service
Tidy Riders provides cleaning and detailing services intended to remove dirt, debris, stains and general soiling from baby and child equipment.
Tidy Riders will carry out cleaning with due care and diligence and will take reasonable steps to prevent damage to the item being cleaned.
Cleaning methods will be selected based on the type, construction and manufacturer's care requirements of the individual product.
The customer acknowledges that cleaning is a physical process and that some incidental wear, fading, discolouration or other changes to a product may occur during cleaning, particularly where an item has been heavily soiled, aged or previously exposed to wear.
2. Condition Before Cleaning
Customers should advise Tidy Riders of any known damage, defects, previous repairs, missing components or other concerns before an item is cleaned.
Tidy Riders may identify existing damage or deterioration during the cleaning process that was not reasonably visible beforehand.
Tidy Riders is not responsible for pre-existing damage, deterioration, fading, weakened materials or defects that become apparent during or following cleaning.
Where Tidy Riders considers an item to be unsuitable for cleaning due to its condition, construction or other concerns, Tidy Riders may decline to proceed with the service.
3. Cleaning Results
Tidy Riders will make reasonable efforts to achieve the best possible cleaning result.
However, a completely stain-free or "as new" result cannot be guaranteed.
Some stains, discolouration, odours and embedded dirt may be permanent or may not be able to be completely removed without using cleaning methods that could damage the product.
The age, condition, material, previous use and level of soiling of an item may affect the final result.
4. Child Car Restraints & Baby Capsules
Child car restraints and baby capsules can be particularly difficult to clean due to their construction.
Certain areas of a restraint shell, harness system, padding or other components may have limited access, meaning that dirt, debris or soiling cannot always be completely removed.
Tidy Riders will make reasonable efforts to clean accessible areas and remove dirt and soiling without compromising the integrity of the restraint.
The customer acknowledges that some areas may remain partially soiled where access is restricted by the physical construction of the restraint.
Tidy Riders will not dismantle, modify or alter a child restraint beyond what is permitted by the manufacturer's cleaning and care instructions.
5. Cleaning of Safety Equipment
Where the item being cleaned is a child car restraint, baby capsule or other safety-related product, Tidy Riders will follow applicable manufacturer cleaning instructions and appropriate cleaning practices.
The customer must not request or expect Tidy Riders to use cleaning methods that are contrary to the manufacturer's instructions or that could compromise the safety or integrity of the product.
Where a particular component cannot safely be cleaned using the manufacturer's recommended methods, Tidy Riders may leave that component untreated or partially treated.
6. Britax Child Restraint Height Marker Disclaimer
Britax has acknowledged a manufacturing defect affecting certain batches of child restraint covers where the printed height markers may wash off, rub off, fade, discolour or otherwise deteriorate, including when the cover is cleaned using gentle washing methods in accordance with the manufacturer's cleaning instructions.
Where a Britax child restraint is cleaned or detailed by Tidy Riders and the height markers subsequently wash off, rub off, fade, discolour or otherwise show signs of this known defect, the customer acknowledges that this may be the result of the existing manufacturing defect rather than incorrect cleaning or negligent servicing by Tidy Riders.
To the fullest extent permitted by law, Tidy Riders accepts no responsibility for deterioration or loss of the height markers where this known manufacturing defect occurs.
Where this occurs, the customer should contact Britax directly regarding replacement of the affected cover set.
The customer acknowledges that the occurrence of this defect may be unavoidable where an affected cover is cleaned, including where Tidy Riders has followed appropriate cleaning methods.
7. Additional Servicing & Repairs
Cleaning and detailing does not include repairs, replacement of components or other servicing unless specifically agreed.
During the cleaning process, Tidy Riders may identify components that are loose, damaged, worn, missing or otherwise require attention.
Examples may include loose restraint components, damaged plugs or fittings, worn hardware, rivets, screws, washers, spacers, O-rings or other product-specific components.
Where additional servicing or replacement parts are recommended, Tidy Riders will advise the customer where reasonably practicable.
Any additional cost for parts, servicing or repairs will be discussed with the customer before the additional work is undertaken.
The customer may choose whether or not to proceed with additional servicing.
8. Existing Damage & Deterioration
The customer acknowledges that baby and child equipment can experience wear and deterioration through normal use.
This may include:
- fading;
- discolouration;
- fabric deterioration;
- weakened stitching;
- worn plastics;
- scratches;
- scuffs;
- rust or corrosion;
- deterioration of foam or padding; and
- deterioration of other materials.
Cleaning may make existing damage or deterioration more visible.
Tidy Riders is not responsible for damage or deterioration that existed before the cleaning service or that becomes apparent as a result of the cleaning process where reasonable care has been taken.
9. Customer Responsibility
The customer is responsible for providing accurate information about the item's condition and any known defects or concerns before cleaning.
Customers should remove personal belongings and loose items from prams, capsules, car restraints and other equipment before the item is provided for cleaning.
Tidy Riders is not responsible for personal belongings, loose items or items left inside equipment that are lost, damaged or discarded during the cleaning process.
10. Equipment Returned After Cleaning
Customers should inspect their equipment when it is returned following cleaning.
Where a customer believes that damage has occurred during the cleaning service, they should notify Tidy Riders as soon as reasonably possible so that the matter can be assessed.
Tidy Riders will consider any reported concerns fairly and will assess whether the issue appears to have resulted from the cleaning service, pre-existing damage, normal wear or another cause.
11. Liability
Tidy Riders takes reasonable care when cleaning and detailing equipment and will use cleaning methods appropriate to the product wherever reasonably possible.
However, to the fullest extent permitted by law, Tidy Riders is not responsible for incidental wear, fading, discolouration, deterioration or damage that occurs as a result of the inherent characteristics, age, condition or construction of the product, where reasonable care has been taken.
Tidy Riders is also not responsible for pre-existing defects or damage that become apparent during or after cleaning.
12. Acceptance of Terms
By booking or providing an item to Tidy Riders for cleaning or detailing, the customer acknowledges that they have had the opportunity to read these Terms & Conditions and agrees to them.
The customer acknowledges that cleaning is intended to improve the cleanliness and presentation of an item but cannot guarantee the removal of all stains, dirt, odours or existing deterioration.
The customer also acknowledges that some products, particularly child car restraints, have construction limitations that may prevent complete cleaning of every area.
